‘Real Martha’ Baby Reindeer lawsuit to go forward as judge rules series not a ‘true story’

Fiona Harvey’s defamation lawsuit against Netflix has been allowed to go forward after a judge ruled that the streamer’s hit series Baby Reindeer did not match up to its billing as a “true story”.
The series, which follows a struggling comic Donny Dunn (Richard Gadd) as he is relentlessly harassed and stalked by a woman named Martha Scott (played by Jessica Gunning) for more than four years, was embroiled in controversy when internet sleuths unearthed the “real Martha” as Scottish lawyer Harvey.
Harvey responded by filing a defamation lawsuit against Netflix in which she alleged that the story is inaccurate and falsely depicted her as a convicted criminal who spent time in prison for stalking.
In July, Netflix filed a motion to throw out the lawsuit, with the show’s creator and star Gadd revealing that Harvey had stalked him when he worked at a London pub, and had sent him thousands of disturbing emails and voicemail messages.
In a ruling on Friday, Judge Gary Klausner stated that the series opens with the line “This is a true story,” which invites the viewer to take what is presented to them as fact. However, Judge Klausner found that Martha’s behaviour in the show is depicted as much worse than what Harvey was accused of in real life.
In the series, Martha pleads guilty to stalking and harassment and is sent to jail. However, Gadd reported Harvey to the police and she received a warning but was not criminally prosecuted as the series suggests.
“There is a major difference between stalking and being convicted of stalking in a court of law,” the judge wrote. “Likewise, there are major differences between inappropriate touching and sexual assault, as well as between shoving and gouging another’s eyes. While plaintiff’s purported actions are reprehensible, defendants’ statements are of a worse degree and could produce a different effect in the mind of a viewer.”
The court “disagreed” with Netflix’s argument that the similarities between the character Martha and Harvey are “so broad that a reasonable person would not have been able to identify her”.
Instead, the judge said: “Rather, Martha and Plaintiff have specific similarities that few others could claim to share. Specifically, Martha and Plaintiff are both Scottish lawyers living in London, twenty years older than Donny/Gadd, accused of stalking a lawyer in a newspaper article, who communicated with Donny/Gadd on social media.”

Harvey was never named on the show, but her identity was quickly revealed by online sleuths who followed digital breadcrumbs from clues in the series, like searching the wording of specific tweets depicted in the series online – and finding Harvey’s account.
A federal judge has set a 6 May start date for Harvey’s action against Netflix, and proceedings are estimated to last about two weeks.
The series is billed as a “true story,” which Harvey argues in her $170m (£132m) lawsuit is “the biggest lie in television history”.
According to documents seen by The Independent, Harvey has accused Netflix of defamation, negligence, intentional infliction of emotional distress, and violations of her right to privacy among other allegations.
While Gadd isn’t named as a defendant in the lawsuit, he filed a response in federal court defending a motion to dismiss Harvey’s claim in a declaration dated 28 July.
“I never intended the series to identify any real person as Martha Scott, including Harvey,” he wrote in the 21-page document. “Martha Scott is not Fiona Harvey. Like all characters in the series, Martha is a fictional character with fictional personality traits that are very different than Harvey’s.”
A Netflix spokesperson said at the time of the lawsuit’s filing: “We intend to defend this matter vigorously and to stand by Richard Gadd’s right to tell his story.”
Despite the controversy surrounding the series, Gadd’s show won four Emmy awards and 11 nominations at the 2024 ceremony earlier this month.
The Scottish comedian used his acceptance speech to encourage “struggling” abuse survivors to “keep going,” promising them that “things will be OK”.

Another is thought to be This Morning editor Martin Frizell, who Phil seems to blame for letting him take the fall over “queuegate” when he and Holly were accused of pushing in to see the Queen lying in state.
Other targets could include ITV chief Dame Carolyn McCall.
Discussing how he was forced to leave This Morning after 22 years following a fling with a much younger man, Phillip, 62, rants: “They know how important that was to me.
“They know when you throw someone under a bus, you’ve got to have a really bloody good reason to do it. Brand, ambition is not good enough.”
He goes on: “People can be fake. They can be so fake with you when it’s all going well, and suddenly utter, utter betrayal.
“There are a lot of amazing people in morning television.
“I think there are only three sh*s. One of them is a coward who never stepped up in queuegate.
“One is a coward, because they never stepped up when I was being battered And the other is just brand-orientated.
“Not what you expect, not what you think you’re going to get.”
In a dig at his former management firm YMU, which still represents top TV talent, Phillip reveals they axed him by text.
He says: “I was suicidal and they sent me what looked like a cut and pasted text.
“Thirty one years. There is so much more I could say.”
Elsewhere in the three-parter which sees him spend ten days alone on a small island off Madagascar, Phillip hints the show is his showbiz swansong.

Holly, 43, yesterday shrugged off the controversy, celebrating the third birthday of her wellness company Wylde Moon.

Saturday Night Live star Bowen Yang has shared more details about the unnamed host who he said made cast members cry.
During an appearance on Watch What Happens Live With Andy Cohen last month, Yang was asked to reveal the worst SNL host behavior he’d ever witnessed. “This man – this person, this host – made multiple cast members cry on Wednesday before the table read because he hated the ideas,” he responded.
Yang was asked to elaborate on the incident during Wednesday’s episode of David Spade and Dana Carvey’s Fly on the Wall podcast.
Yang said it was “more about the environment of the place” than the celebrity host’s behavior alone.
“Imagine you stay up until 4am writing a sketch, and then the host is like: ‘I f***ing hate this,’ you’re gonna have some [reaction],” he explained. “Your nerves are frayed.
“You’re gonna have some weird, bizarre, emotional response,” Yang continued, adding that he wasn’t “the one who cried.”
Carvey and Spade, who both starred in the long-running NBC sketch series in the Nineties, sympathized with their fellow comedian.
Spade recalled getting in trouble for saying that Steven Seagal had been the worst host to work with on SNL during a 2015 interview on Watch What Happens Live.
“Everyone gets in trouble for saying something, but that’s what everyone asks, and you can only dodge it for so long,” Spade said. “You just try to explain why they weren’t great.”

Spade said of Seagal at the time: “He was a little tough. I mean, he was actually tough, and he was tough to work with. It was hard. He did not want to play along.”
SNL returns on 28 September with a re-assembled lineup of familiar faces, plus three new cast members.
The new series will see Maya Rudolph reprise her Emmy-winning take on Vice President Kamala Harris amid her bid for the presidency.
Yang first joined SNL as a writer in 2018 before he was promoted to part of the on-air cast a year later.
Since joining as a full-time cast member, some of Yang’s most memorable skits have included him portraying a talking balloon in reference to the suspected Chinese spy balloon that was shot down by the US military in February 2023. In October 2022, he also memorably skewered Elon Musk, Kanye West, Joe Biden and Chris Pratt during the show’s cold open.
In 2021, Yang made SNL history as the first Chinese American cast member to receive an Emmy nomination for Outstanding Supporting Actor in a Comedy Series, which he earned after having only appeared on two seasons of the NBC comedy sketch show.
Elsewhere on the Fly on the Wall podcast, Yang said season 49 host Sydney Sweeney “practically begged” the SNL cast to “make jokes about my boobs.”

DANI Dyer has asked fans for help after one of her twin daughters contracted a nasty infection that has left her scratching and bleeding.
The former Love Island star is a proud mum to one-year-old twin daughters, Star and Summer, and three-year-old son, Santiago, but has been struggling after they’ve all fallen sick.

However, taking to Instagram today, Dani revealed poor baby Star has got the worst of it after contracting a painful illness.
In the video, the kids can be heard screaming in the background as she talks to her followers from her kitchen counter.
She told her fans: “Star’s got hand, foot and mouth, and you can’t do anything about that, can you?
“I’ve looked and looked, but is there any remedies because she is scratching it so much she is bleeding.”
Explaining she was due a phone call with the doctor to try and get help, she added: “I know they genuinely can’t do anything, and now I’m looking at Summer thinking ‘you’re going to get it.’”
“I just feel like the illnesses are constant,” said the exhausted mum. “A few weeks ago Santiago had impetigo, then chicken pox, then Star got a little impetigo.
“Star is usually the sickly one, if anyone is going to get ill out of the twins it is usually Star. I can’t leave the house!”
Hand, foot and mouth, according to the NHS, is common in young children and usually gets better on its own between seven to ten days.
Symptoms include a sore throat, high temperature and mouth ulcers, as well as a rash on hands and feet.
The illness leaves those suffering from it with a low appetite.
It is not, as is sometimes assumed, related to foot and mouth disease which affects animals.
Dani later took to Instagram again to thank followers for their kind messages, sharing that Star had managed to finally get some sleep, with the hope she would feel slightly better once she woke up.
“In my personal opinion, I feel like hand, foot and mouth is worse than chicken pox,” she added. “Star has cried all morning, she’s had a sleep this afternoon, so I’m hoping she wakes up better, but she’s in so much pain, like her mouth…
“It’s just worse than chicken pox.”
What is Hand, Foot and Mouth?
Hand, food and mouth disease is a common infection.
It causes mouth ulcers and spots on the hands and feet.
Though children aged 10 and under are more likely to catch it, it can affect older children and adults as well.
There is no cure for hand, foot and mouth disease so you have to let it run its course.
The best thing to do is to stay at home until you are feeling better.
To help ease the symptoms you can:
- Drink plenty of fluids to avoid dehydration – water and milk are ideal
- Eat soft foods such as mashed potatoes, yogurt and soups if eating and swallowing is uncomfortable. Avoid hot, acidic or spicy foods and drinks.
- Over-the-counter painkillers, such as paracetamol and ibuprofen can ease a sore throat and fever.
- Gargling with warm, salty water can relieve discomfort from mouth ulcers or you can use mouth gels, rinses or sprays.
Children should be kept away from nursery or school until they are feeling better. Adults should stay away from work.
Medical attention is not usually needed unless your child is unable or unwilling to drink fluids, has signs of dehydration, develops fits, confusion or weakness, or if the symptoms get worse/have not improved after seven to 10 days.
She added that her mum Jo, is also sick so wasn’t able to come and help her, before sarcastically laughing and adding: “I’m really enjoying myself. If I don’t laugh, I’ll cry.”
Dani is engaged to footballer Jarrod Bowen, with the West Ham star getting down on one knee and proposing in July while on holiday in Spain.
The couple have been together since 2021, and together they share twins Star and Summer.
Santiago was born during Dani’s relationship with former partner, Sammy Kimmence.
