Netflix show Baby Reindeer ruled ‘libellous’ allowing Fiona Harvey to press ahead with £132m case
TELLY’S Baby Reindeer has been ruled potentially libellous — allowing the “real life Martha” to press ahead with a £132million case against Netflix.
Scottish lawyer Fiona Harvey said the hit show, watched by 50million viewers worldwide, had defamed her.
Billed as a “true story”, it told of a stalker targeting an aspiring comedian working in a pub.
Ms Harvey, 58, said she was identifiable and subject to “brutal lies”.
She has never been convicted of stalking the show’s creator Richard Gadd, 35.
In July, Netflix filed a motion to throw out the case, but a Californian court has now ruled against it.
Judge Gary Klausner said: “There is a major difference between stalking and being convicted of stalking and likewise between inappropriate touching and sexual assault.”
Sun writer and broadcaster Piers Morgan just tweeted: “Wow.”
The seven-parter, first aired in April, won six Emmy awards.

Phillip Schofield: ‘utter betrayal’ made me never want to be a presenter again | Phillip Schofield
Phillip Schofield says the “utter betrayal” by his television colleagues has made him never want to be a daytime presenter again as he returns to the small screen.
The 62-year-old former This Morning presenter will be seen in Channel 5’s Phillip Schofield: Cast Away, his first appearance on a TV series since he left ITV in May 2023 after he admitted to an “unwise but not illegal” affair with a younger male colleague.
When he resigned more than a year ago, he denied having been “forced out” of the daytime show, and said he was “so very, very sorry” for lying to the channel, his colleagues and his wife and friends.
However, on the fourth day on the small island of Nosy Ankarea, off the coast of Madagascar, Schofield claims he was “chucked under a bus” and that he could do the same to others but he is “not that sort of person”.
In the second episode, he says he had expected to “die on live television at 93”, but now he does not think he wants to do it any more because he has been “hurt so badly” by being a presenter, and “some of the people on that sort of telly”.
Schofield says that when he started at the BBC as a booking clerk at 19, he was able to go to Television Centre, where ITV’s This Morning was later filmed, and “loved being there”.
He adds: “When what happened to me happened to me, it screwed up my favourite building in the world, and it pretty well blew away all those happy memories, and suddenly the place became hostile to me, and that was heartbreaking.
“And the people who did it to me know, they know how important that building was to me.
“They know that when you throw someone under a bus, you’ve got to have a really bloody good reason to do it. Brand, ambition is not good enough. It’s not a good enough reason to throw someone under a bus.”
He adds that “people can be so fake with you when it’s all going well, and suddenly utter, utter betrayal”.
“When the tidal wave washed through and it washed everybody away. The ones that are still standing. They’re the ones that matter. And I thought: ‘How many friends do you need?’ I don’t need 200 fake friends. I’ve got, what? Ten, 15 friends that I would die for; they would die for me.”
He also claims the relationship would not have mattered if he was not gay, and suggests an affair with a woman would have meant a “pat on the back”.
“I think another TV presenter or two might have done exactly the same thing, difference is, heterosexual, it’s not an unusual thing in the gay world for there to be a difference in age groups.”
On day six, he climbs the island’s mountain, and reflects on life outside television.
A video is also shown from before he took on the challenge in which he says: “You’ve got to look elsewhere, and you’ve got to see: where does that path go? Because I can’t go down that one any more.”
On reaching the summit, he cites the poem Welcome to Holland – in which someone going on holiday to Italy goes somewhere they do not expect – by Emily Perl Kingsley that his therapist sent to him.
While looking out at the view, Schofield says: “Holland is a lovely place, with lovely people … and it’s not quite where you thought you were going to go, but it’s rewarding and it gives moments like this.”

Bond girl Britt Ekland believes next 007 film should go straight to streaming
BOND girl Britt Ekland reckons the next 007 film should go straight to streaming sites instead of the cinema.
She believes home movies are the future and will eventually kill off big-screen outings.
Swedish star Britt, 81, played Mary Goodnight in 1974’s The Man with the Golden Gun alongside Roger Moore as James Bond.
The film grossed £73million.
Britt told The Sun on Sunday: “I believe cinema will fade out and streaming is the way to go.
“We have to be realistic — yes, a new Bond film will sustain cinema for a while but I’m sure the way to make money in the future is streaming.
“Personally I love streaming as I can go on my exercise bike and do an hour watching something exciting while I get fit at the same time.”
The last Bond film, No Time To Die starring Daniel Craig, made £600million after it was released in 2021.
Eon Productions, which makes the spy films, is tied to a deal with MGM Studios — bought by Amazon in 2022.
Brit Aaron Taylor-Johnson is set to take over as the new 007.
Britt will appear at London’s O2 on October 13 to mark the golden anniversary of The Man with the Golden Gun.

Will & Harper: Will Ferrell breaks down in tears over transphobic abuse of Harper Steele in Texas
Will Ferrell breaks down in tears after a rough night in Texas with his friend Harper Steele in their new Netflix documentary Will & Harper.
The film follows the friends of 30 years on a road trip across America to reintroduce Steele, former head writer at Saturday Night Live, to her country after she came out as a trans woman and transitioned during the pandemic.
At one point on the trip, the duo stop at the Big Texan Steak Ranch in Amarillo, Texas, where they take on its famous 72-ounce steak-eating challenge.
The two are placed on a stage to complete the challenge and a crowd quickly gathers around them as diners film and take photos of Ferrell.
“As much as I’ve been in a fishbowl in various times in my life, this trumps all of it,” Ferrell says in the restaurant.
The film then shows a selection of transphobic tweets about Steele shared after the public sighting.
In the car the next day, Steele says: “The room started to feel very… wrong to me, and, I mean, the crowds that come around you so quickly. I was feeling a little like my trans-ness was on display, I guess. And suddenly, that sort of made me feel… not great.”
Ferrell begins to cry before saying: “The saddest part for me is, uh… I just feel… I feel like I let you down in that moment.”
Steele comforts her friend before the Step Brothers star adds: “I was like, ‘Oh, s***, We gotta worry about Harper’s safety.’ You know, like what… That’s where I just… I feel like I… Yeah.”

Directed by Josh Greenbaum (Barb and Star Go to Vista Del Mar), the new documentary film premiered at the 2024 Sundance Film Festival and was acquired by Netflix.
In 2022, at the age of 61, Steele sent Ferrell a letter in which she told him she is trans, and was newly in the process of transitioning. “I just ask you as my friend to stand up for me,” Steele wrote. “Do your best to, if I’m misgendered, just speak up on my behalf, that’s all I ask.”
In a recent interview for The Independent, Adam White asked Ferrell why he thought transphobia exists.
The comedy star replied: “There is hatred out there. It’s very real and it’s very unsafe for trans people in certain situations. But I don’t know why trans people are meant to be threatening to me as a cis male. I don’t know why Harper is threatening to me.
“It’s so strange to me, because Harper is finally… her. She’s finally who she was always meant to be. Whether or not you can ultimately wrap your head around that, why would you care if somebody’s happy? Why is that threatening to you? If the trans community is a threat to you, I think it stems from not being confident or safe with yourself.”
