Caroline Ellison, the star witness in the prosecution of her former boyfriend, FTX founder Sam Bankman-Fried, was sentenced Tuesday in New York federal court to two years in prison and ordered to forfeit $11 billion for her role in the massive fraud and conspiracy that doomed the cryptocurrency exchange once valued at $32 billion.
The prison term was significantly stiffer than the recommendation by the federal Probation Department that Judge Lewis Kaplan sentence Ellison to three years of supervised release, with no time at all behind bars. Ellison’s lawyers also had asked for a no-prison sentence.
Ellison, who had run Alameda Research, a hedge fund connected to FTX, agreed to a plea deal in December 2022, a month after FTX spiraled into bankruptcy.
Ellison, 29, pleaded guilty to conspiracy and financial fraud charges.
Bankman-Fried, in contrast, chose to stand trial and was convicted of all seven criminal fraud charges against him in U.S. District Court in Manhattan.
He was sentenced to 25 years in prison in March and ordered to pay $11 billion in forfeiture.
Bankman-Fried since then has appealed his conviction, and requested a new trial and a different judge, arguing that Kaplan was biased against him.
Late Monday, Ellison’s attorneys in a court filing said they had finalized financial settlements with prosecutors and the FTX debtor’s estate.
Both Bankman-Fried and Ellison had faced the same statutory maximum sentence of about 110 years in prison for their crimes.
But defendants in criminal cases who cooperate with prosecutors instead of fighting the charges particularly in white-collar cases such as FTX, often receive leniency when they are sentenced.

Though Google launched the Pixel Watch 3 this year, those who are still rocking older Pixel Watches aren’t being left behind. Google has just announced that the original Pixel Watch and the Pixel Watch 2 will receive the latest Wear OS 5 update, which will begin rolling out today.
Those who still have the Pixel Watch 1 and Pixel Watch 2, which should be running Wear OS 3.5 or Wear OS 4.0, respectively, are now getting the September 2024 software update to Wear OS 5.
It will begin rolling out today and will continue to expand over the next week in phases, depending on the carrier and device. If you have an eligible Pixel Watch, you should get a notification on the watch once this over-the-air update is available. Google encourages users to update to get the latest software, as staying up to date means fewer security vulnerabilities.
When you upgrade to Wear OS 5, you will receive new features, plenty of good old bug fixes, and improved performance on the Pixel Watch. You will also receive app updates via the Play Store to obtain a new grid-view app launcher, improved camera controls, and the Pixel Recorder app.
One of the most significant changes is the grid-based app launcher. This is visually similar to launchers from other manufacturers that use Wear OS. Users can choose between this one or the list-based app launcher that was available on previous Wear OS versions.
Wear OS 5 also enhances the Watch Face format. These include flavors, goal progress complication types, weather conditions, and a heart rate system data source.
For runners, Wear OS 5 has more detailed running metrics that should be helpful. With Wear OS 5, you get ground contact time, stride length, vertical oscillation, and vertical ratio metrics. This is especially useful if you are training. There are also debounced goals, which are helpful for those who want to maintain a threshold or range, such as a specific heart rate when working out.
To check for the update on your Pixel Watch, open the Settings app, select System > System updates. If the update is ready for you, the page should refresh and start downloading it.
Generative Artificial Intelligence (Gen AI) tools are now battling each other online. An AI copyright tool is actively serving takedown notices to social media posts containing Mario and other content copyrighted by Nintendo.
AI copyright tool going after AI-generated Mario images
Ever since Gen AI burst on the scene, AI-generated images and videos have been flooding the internet. Social media users are churning out a lot of content using Gen AI tools, and a lot of the imagery appears to ignore copyright laws.
An AI copyright tool is now going after AI-generated content on X (formerly Twitter). Several dozen posts of X have been reportedly taken down. Most of these posts contained images of Mario, which were generated using AI.
According to The Verge, a company called Tracer is using AI to identify the images and serve takedown notices on behalf of Nintendo. The publication posted an AI-generated picture of Mario holding a beer and a cigarette, and sure enough, it was taken down.
The Verge’s Tom Warren received an email shortly after the image was taken down. It indicated a Digital Millennium Copyright Act (DMCA) notice was issued to X. The person serving the notice was “customer success manager” Ben Arzen of Tracer.
Tracer is a relatively new company that offers AI-powered services to companies. The company’s AI helps to identify trademark and copyright violations online.
AI tools are also targeting fan art posts
X introduced Grok, its in-house developed Gen AI, a few months ago. Grok is essentially a multi-faceted Gen AI tool that can generate text and images. Grok rivals ChatGPT, Mid-Journey, Dall-E, and other similar Gen AI tools.
It appears the AI copyright tool is predominantly active on X. Moreover, so far, only Nintendo appears to be going after content that the company considers copyright infringement.

Some reports suggest the AI tool serving takedown notices is also targeting fan art. Needless to say, this is quite concerning because fan art is content that’s created by individuals and not generated using AI.
Regardless, it might be difficult for an AI tool to make the distinction between user-created and AI-generated art. Moreover, Nintendo has always been very aggressive while dealing with copyright issues. Hence, it makes sense Nintendo hired one of the first companies to use AI to go after AI-generated content.
