🚨 The CLARITY Act passed 15-9 BIPARTISAN yesterday — but there’s a hidden catch at the last minute that almost nobody is talking about.
Eleanor Terrett scoop: Last-minute negotiations between Banking Committee Republicans and Democrats were brokered the morning of the vote to secure bipartisan support. The compromise came at a cost — a Lummis amendment was modified to REMOVE language from Section 301 referencing the Blockchain Regulatory Certainty Act (BRCA) (Eleanor Terrett via X).
DeFi advocates say this could strip out critical protections for software developers as the bill moves forward.

It gets worse for the floor vote:
🎯 Blockchain Association’s Lindsay Fraser confirmed on CoinDesk: “Both Senator Gallego and Senator Alsobrooks said that their yes vote in committee does NOT indicate that they will be a yes on the floor. They need some sort of ethics language.” (CoinDesk)
🎯 Mark Warner (D-VA) positively referenced the changes during the markup — but STILL voted no.
🎯 Bernie Moreno said at the hearing: “There’s still work to be done on Section 301” — signaling weeks of work ahead.
