Gavin Andrews, 34, died from his injuries in a collision while crossing Walmersley Road, near the Towler Inn Pub in Bury on November 9, 2021.
Faizaan Haider, 25, of Mosley Avenue, Bury, and Suaiel Haider, 43, appeared at Manchester Minshull Street Crown Court on Friday.
Faizaan Haider is charged with causing death by dangerous driving and causing death while driving unlicenced or without insurance.
Suaiel Haider, who the court was told is Faizaan’s uncle, is charged with committing an act to pervert the course of justice, namely setting fire to a BMW 6 Series.
Both have pleaded not guilty.
Geoff Whelan, prosecuting, told the court how the two defendants had been at a wake in a restaurant earlier on the day of November 9.
He said: “[Faizaan] had been at a wake earlier in the day and he had been drinking.”
Mr Whelan said that a waitress at the restaurant had seen him come to the bar “a few times” to order “Jack Daniels and coke”, “brandy” and “sambuca”.
He said: “She said they drank an excessive amount and that they were drunk.”
Mr Whelan said that just after 4.27pm, Faizaan was seen on CCTV “setting off fireworks in the car park”.
Mr Whelan said that at 9.28pm Faizaan and Suaiel were seen again on CCTV getting into the BMW, with Faizaan in the driver’s seat.
He said: “Faizaan then reversed the BMW down Hamilton Street and this was about four minutes before the fatal collision.”
Mr Whelan said that at 9.31pm, a taxi carrying Mr Andrews was parking up to take him to a Chinese takeaway.
He said: “Mr Andrews left the taxi on the side of the Towler Pub and crossed the road to get to the takeaway.
“The taxi driver said it was raining, it was dark and while he was waiting for Mr Andrews the driver saw the vehicle pass.
“He said it was travelling at a high speed and as it passed he heard a loud noise and a loud banging.”
Mr Whelan played CCTV footage of the night showing Mr Andrews crossing the road in the dark while it was raining.
He then showed Mr Andrews being hit by the car when he crossed the road again.
Mr Whelan said: “Another driver who was driving in the opposite direction just after the collision saw a BMW going past.”
He said the driver said the car was “trucking it” and “he felt the speed was about 70mph.”
Mr Whelan said Mr Andrews was “struck by the BMW and thrown a considerable distance”.
He said: “He died at the scene from multiple injuries.”
Mr Whelan said that the driver “failed to stop”.

He said that another witness, who was in her house, heard “the noise of car doors banging”.
Mr Whelan said: “She looked out of her window and she saw two males walking away from a parked vehicle and one male lighting a fire on the seat of the car.
“She said he was bald and the only one who matches that description is Suaiel Haider.”
Mr Whelan said she placed a call to 999 at 9.39pm to report that the car was on fire.
Suaiel was arrested on December 2, 2021 and Faizaan was taken into custody a day later.
Mr Whelan said they replied “no comment” to every question asked after being informed that anything they said could be used against them in court.
Mr Whelan said that a forensics report on the incident determined that the car was travelling “no less than about 57mph”.
He said: “Mr Andrews may have been aware of the vehicle but had misjudged its speed.
“Had the BMW driver been travelling the speed limit of 30mph it would have given Mr Andrews appropriate time to be out of the road.”
