The story of the US is, in many ways, remarkable. It achieved independence against the odds, its constitution has lasted more than two centuries and its democracy has weathered war, economic depression, social upheaval and political change. But reflection on American history rarely settles into simple celebration.

From the beginning, the US was an experiment rather than an inheritance. It was built on the idea that free people could govern themselves through constitutional institutions. And because of that, Americans have repeatedly wondered whether the experiment was in danger of failing.

In some cases, fears proved exaggerated. In others, they were justified. But taken together, these moments reveal that fear of constitutional failure has been a recurring theme throughout US history. As the US approaches its 250th anniversary, several events stand out as moments of constitutional peril.

1. Tensions with France

The first major test of the constitution arrived soon after its signing in 1787. Eleven years later, in 1798, the formal alliance between the US and France was replaced with intense mutual hostility and paranoia as tensions grew over diplomatic insults and French attacks on American shipping. Congress passed the Alien and Sedition Acts as a response to external threats and domestic instability.

But critics saw something different: a government using fear to suppress dissent. The Sedition Act made certain criticisms of federal officials a crime, with newspapers and political opponents becoming targets of prosecution. For a nation that had recently fought a revolution in the name of liberty, this episode exposed an uncomfortable reality that constitutional rights could not be assumed.

The significance of the Alien and Sedition Acts lies not in their three-year duration but in the questions they raised. How much liberty are citizens willing to surrender when they believe the nation is under threat? And how much dissent can a democracy tolerate? Those questions have returned throughout American history.

2. The civil war

No crisis would test the republic more severely than the civil war in 1861. The decision of southern states to secede from the US shattered the assumption that political disagreements would remain within constitutional boundaries. This turned the long-running conflicts over slavery, citizenship, federal authority and the meaning of the union itself into open war.

Had the Confederacy succeeded, the US would probably have ceased to exist in the form envisioned by its founders. Yet even this example is more complicated than a simple narrative of survival. The union was preserved, slavery abolished and new constitutional amendments transformed legal definitions of freedom and citizenship. But these promises were only partially fulfilled.

The US government abandoned its efforts to protect the rights of newly freed Black Americans after the civil war, allowing the southern states to enforce legalised racial segregation and systemic disenfranchisement for nearly a century. This reminds us that constitutional survival and constitutional justice are not always the same thing.

3. McCarthyism

The 20th century brought new challenges. During the cold war, fears of communist influence and Soviet espionage spread throughout American society. Some fears were grounded in reality, but the atmosphere created by the “second red scare” (1947-59) extended far beyond legitimate security concerns.

Commonly associated with Senator Joseph McCarthy, this period is remembered not because Americans feared communism but because fear itself became politically powerful. Loyalty investigations, blacklists and public accusations affected thousands. People found their careers damaged or destroyed based on suspicion, association or allegations.

McCarthyism remains historically significant because its underlying dynamic is so familiar. When faced with threats, democratic societies often struggle to uphold civil liberties. This episode raises a broader question that remains relevant today: can a free society preserve its freedoms when citizens believe those freedoms are being exploited by enemies?

4. Watergate scandal

The Watergate scandal of 1972 to 1974 presented a different kind of constitutional challenge. What began as a burglary at the Democratic National Committee headquarters in Washington quickly evolved into broader investigations. These investigations exposed direct efforts by President Richard Nixon to obstruct justice, misuse government agencies and conceal wrongdoing within the executive branch.

At its heart was a central question: was the president subject to the law? Democracies depend on elections but also limits to power, even when that power is exercised by democratically elected leaders.

What makes Watergate noteworthy half a century later is not just the misconduct that was uncovered, but the response it provoked. Journalists investigated, courts asserted their authority, Congress conducted oversight and ultimately Nixon resigned. While Watergate shook public confidence, it demonstrated that constitutional checks and balances could function when tested.

5. The 2020 election

The most recent chapter in America’s story remains close enough to the present that its full historical significance is still debated. The aftermath of the 2020 election and events on January 6 2021, when Trump supporters staged a violent attack on the US Capitol building in Washington, exposed divisions over elections, legitimacy and democratic norms.

The attack disrupted a process that Americans had taken for granted: the formal certification of a presidential election and the peaceful transfer of power. What made this episode so important was the challenge it posed to confidence in electoral processes themselves. Democracies depend upon winners and losers accepting constitutional outcomes, even when they are disappointed by them.

The constitutional system ultimately carried out its responsibilities. Courts heard challenges, state officials certified results, Congress completed the certification process and the transfer of power took place. Yet this episode left enduring questions about public trust, political polarisation and American democratic health.

As Americans prepare to mark 250 years of independence, these different episodes suggest that constitutional government has never been self-sustaining. From fears of republican collapse to concerns about civil war, political repression, executive overreach and contested elections, each generation has confronted its own version of constitutional peril.

Perhaps the most remarkable feature of the American experience is not the crises themselves, but the debates over how to preserve the republic have endured alongside them. America’s constitutional democracy is not a finished achievement. It is a continuing project, renewed and tested by every generation.

WASHINGTON (AP) — Former CIA Director John Brennan sued the Trump administration on Wednesday, demanding a court order that would require officials to preserve records from investigations that he says are targeting him.

Brennan said in the lawsuit that the records would be essential for him to mount a defense on vindictive prosecution grounds in the event of a future indictment brought by the Republican administration.

“To fully consider those motions, the reviewing judge would need to scrutinize the motivations of the Justice Department officials who directed, oversaw, or undertook those actions to determine whether they violated Director Brennan’s rights, and specifically whether they were motivated by a desire to vindictively prosecute him as an act of retribution,” Brennan’s lawyers wrote in the lawsuit filed in federal court in Washington.

The lawsuit names as defendants President Donald Trump and other top law enforcement officials from his administration, including acting Attorney General Todd Blanche, FBI Director Kash Patel and the prosecutors in Florida who have been overseeing investigations related to Brennan and other former government officials.

The 16 children found living in “deplorable” conditions inside an Ohio home are part of the same family, officials said Wednesday.

Authorities arrested four adults Tuesday on felony child endangerment charges after finding the children in a rural southern Ohio home. Some were in dire need of medical treatment, authorities said.

The four people charged appeared in court Wednesday where a judge entered not guilty pleas on their behalf.

Ohio Attorney General Andy Wilson said Wednesday that the conditions inside the house were almost indescribable, saying it “really looked third world.”

“It’s just almost beyond comprehension,” he said without providing details about what was inside.

It appeared that the children spent most of their time in just one room for much of the four years they lived there, Wilson said.

The Ohio Bureau of Investigation and local sheriff’s department searched the home in the small village of Hamden on Tuesday.

Law enforcement arrested Gary Siders Jr., Gary Siders Sr., Christina Siders and Elizabeth Siders. They have not yet been assigned lawyers.

Vinton County prosecuting attorney William Archer said they were charged with second-degree felony child endangering because it involves “serious physical harm.”

Hamden has a population of less than 1,000 people and is about 60 miles (97 kilometers) southeast of Columbus.

The children ranged from ages 1.5 to 18 and included both boys and girls, officials said. Seven were transported to hospitals in Columbus and two were flown by helicopters.

Good afternoon and welcome to second-round Wimbledon coverage of Jannik Sinner versus Nuno Borges.

Sinner, the defending champion, struggled in his opener against Miomir Kecmanovic, with the Serbian taking the top seed to five sets. The world No 1 awkwardly slipped in the third set and required medical attention but prevailed in the end, coming through 4-6, 6-3, 6-7, 6-2, 6-3.

The match on Monday was not short of drama and incident. Sinner seemed to be struggling with a foot injury that turned his white shoes red but said afterwards it was nothing to worry about.

“Look, the foot is all good, it just seems much worse than it is,” Sinner said. “It’s just a toenail. I didn’t want to disturb Miomir [and take a medical time-out]. I think we both had a good rhythm. It was a great match from both of us.”

Borges had a much easier time in his first-round match. The 29-year-old from Portugal saw off Tristan Boyer in straight sets 6-3, 7-5, 7-5. Borges reached the third round last year which was a marked improvement on his previous showings at SW19 – three first-round exits in a row prior. 

This is a second meeting between the two players, with Sinner leading the head-to-head 1-0. The Italian will no doubt be looking to maintain that winning record.

Founded in 2021, CTS has grown rapidly and now employs around 140 people across its Yorkshire sites in Northallerton, Thirsk and Harworth. The company turned over £45 million in its last financial year, is currently running at around £60 million, and is forecast to reach £100 million by 2028.

The Daily Mail revealed last week how wives and girlfriends of the England team had enjoyed a night out in a New York night spot ahead of the game against Panama last weekend which the Three Lions won 2-0.

The girls put on their glad rags and downed $30 cocktails at the ultra trendy French themed Maison Close venue from 10pm until the joint shut at 2am.

A bouncer at the venue had even told the Daily mail how some of the WAGS had wanted to ‘carry on partying’ and he had suggested another nightclub further along the road.

But in the end the WAGS, led by Ollie Watkins glamorous wife Ellie, decided to have an early night and had back to their hotel where they had a lie in before heading to the Met Life stadium.

Defender John Stones wife Olivia, posted a picture on her social media showing the wags all sat in a row at the venue, which had been a joint birthday and getting to know you bonding session.

She captioned the image as ‘girls night out in the big apple’ highlighting it with Statue of Liberty emoji and a red apple.

Footage posted online and revealed by the Daily Mail, shows Ellie enjoying herself as she dances in the club and in another photo, she is posing with her sister.

A bouncer at the club said: ‘There was around a dozen of them, they were the wives and girlfriends of the English soccer team and they arrived in two limos.

‘They had two security people with them and the party was booked by someone with an English name, I think it was someone’s birthday but I can’t be sure.

‘They were singing and dancing and having a good time, they were doing what young women do when they come to New York, they enjoyed themselves.

‘They were here until 2am when we close and then they wanted to know where else they could carry on parting, I gave them the name of a late night club but I don’t think they went.’

Head coach Thomas Tuchel was asked if this was an opportunity to put on a dinner-time show for the kids, who may have been in bed for each of their group matches.

‘We would love to entertain them,’ the former Chelsea boss said – but warned that a fraught evening may be in store in living rooms across the country.

‘Maybe we need to define entertainment,’ he added. ‘We don’t know what’s coming and I don’t want to ruin expectations.

‘Everyone wants to play exciting football and fun football, but it can also be entertaining if you feel the spirit and the energy of the team. 

‘Hopefully, everyone is allowed to watch tomorrow because they have to go to bed early normally. 

‘Hopefully, they feel the spirit and how much it means to this team. I see it every day, I feel it every day, and hopefully we can transmit it through the TVs and make them proud and happy.’

On a more sober note, Tuchel confirmed that both Jarell Quansah and Reece James would not be in the squad for the closed-roof clash against the Africans, as England’s full-back curse continues. However, he said that both had come close to making the cut.

It came after Ellie, and friends of the England WAGs, were forced to hit back at pundit Roy Keane, after he criticised them for wearing shirts sporting their partner’s names.

Sources say they have vowed to carry on showing their support by wearing the football shirts, as some did last night as England took on Panama in their last group match.

I know you’re going to think me a party-pooper for what I’m about to say, but hear me out.

I’ve been speaking to pension experts who tell me there is one mistake most of us make that could seriously derail retirement – but you’re not going to like hearing it… or the remedy.

Forecasting and analysis firm Oxford Economics will reveal in a report today that 92 per cent of households should be able to cover their essential costs in retirement.

That’s the good news – and is largely thanks to the state pension, which provides the backbone for most incomes in older age.

Now for the bad. Those who take their tax-free lump sum and spend it on anything other than creating an income stream in retirement will see a big hit to their lifestyle when they do finally retire.

The report estimates the proportion of households able to maintain their lifestyle in retirement is eight percentage points lower for those who take theirs than households overall.

Higher earners who take their lump sum are the worst affected because their personal pension – from which the tax-free chunk is taken – forms a greater proportion of their retirement wealth.

I’m hardly going to win friends by telling you not to take yours. 

The option to withdraw 25 per cent of your pension pot tax-free up to a £268,275 cap from the age of 55 (rising to 57 in 2028) is one of the most-loved tax perks around – a well-earned reward for decades of gruelling delayed gratification.

Millions use it for something enjoyable, such as buying a new car, going on a bucket-list holiday or redoing the kitchen.

Such luxuries are hard to pay for solely out of income while you’re working. Many need their lump sum to pay off debts or clear the mortgage ahead of retirement.

But Helen Morrissey at investment platform Hargreaves Lansdown, which commissioned the report, warns that taking it ‘is a bigger decision than most people realise’.

‘People should consider the fallout on their retirement income before going ahead,’ she adds. 

‘Thousands take their lump sum when they don’t have an immediate need for it and put it into a savings account where it earns a low return. It could be earning much more if left invested in a pension.’

There’s no reason why you can’t take your tax-free lump sum over time or delay it until you need it, but it would take a fundamental change in mindset.

Withdrawing it in full has become the default decision, perceived as a no-brainer, according to a report from the Pensions Commission in May.

As many as 83 per cent of people accessing their defined contribution pensions since 2015 have taken a lump sum from at least one of theirs.

The Institute for Fiscal Studies think-tank blames the name. It says we should change it from tax-free ‘lump sum’ to tax-free ‘element’, so it’s no longer seen as something to take all in one go.

Not the catchiest name, but you can hardly blame people for thinking they should take their tax-free cash as a lump sum when it has ‘lump sum’ in the name.

Would-be Prime Minister Andy Burnham and his new Chancellor could help, too. Lump sum withdrawals surged ahead of last year’s Autumn Budget amid fears the Labour Government was poised to slash the perk. 

Savers withdrew a colossal £3.9billion in pension lump sums in the 12 months to October, according to official figures – up 81 per cent compared to the same period in 2022/23.

Burnham could stop this from happening again by pledging not to touch the tax-free lump sum this Parliament.

Finally, maybe we all need to reframe how we think about the lump sum. By not taking it immediately, we’re not giving something up but instead ending up with more money to spend overall.

Say you had a £400,000 pension pot and withdrew 25 per cent as a tax-free lump sum to stash in a savings account earning 3 per cent interest a year. 

You could have about £134,000 by the time you retire ten years later, according to calculations by wealth manager Broadstone.

If your remaining pot kept growing at 5 per cent a year, after ten years it will have reached £448,688, giving you a combined value of £582,688.

However, if you had left the entire £400,000 pension pot to keep growing until age 65 without taking any tax-free cash, it could reach £651,558 – an extra £68,870.

You would now also be able to withdraw a considerably larger 25 per cent tax-free lump sum of £162,889.

That’s more money to spend on fun purchases – or get you through retirement. Put that way, it doesn’t sound so bad after all.

Crown denies protecting Nicola Sturgeon in Murrell plea deal

Prosecutors have insisted they did not remove thousands of pounds worth of purchases from Peter Murrell’s indictment to spare Nicola Sturgeon embarrassment.

More than 700 items worth almost £59,000 – including make-up, women’s clothing, hair products and fitness gear – were dropped from the charge sheet as part of a plea agreement before the former SNP chief executive admitted embezzling more than £400,000 from party funds.

The Crown Office was forced to deny claims made by campaigner Sean Clerkin that the deleted items were intended to shield Murrell’s estranged wife, former First Minister Nicola Sturgeon, insisting the plea was accepted to secure a conviction without the need for a lengthy and costly trial.

Woman mowed down in attempted murder horror

Police have launched an attempted murder investigation after a woman was deliberately struck by a car in broad daylight in Renfrewshire.

The 49-year-old was seriously injured when a white Vauxhall Corsa mounted the pavement on Clippens Road in Linwood at around 3.45pm on Tuesday.

Shocking footage shows two women standing at a bus stop before the car suddenly veers onto the pavement, ploughing into one of them before speeding away. Detectives are appealing for witnesses and dashcam footage as they work to trace the driver.

Gangland lieutenant once targeted by IRA hitmen

A former boxing promoter jailed for helping run notorious gangster Robert “Birdman” O’Hara’s drugs empire was once the target of an alleged IRA assassination plot.

Mario Rea was last week sentenced to six years in prison after admitting his role in O’Hara’s organised crime network, which continued operating while the killer directed associates from behind bars.

The 47-year-old’s long links to Scotland’s criminal underworld previously saw him issued with an Osman warning after intelligence suggested Real IRA-linked gunmen had travelled to Scotland to kill him following a dispute over a tobacco deal.

Man arrested after Livingston stabbing

A man has been arrested after a 62-year-old was seriously assaulted in Livingston.

Emergency services were called to Howden Road West on Tuesday evening where the victim was found with serious but non-life-threatening injuries and taken to hospital.

A 31-year-old was arrested on Wednesday in connection with the incident as police continued their investigation. Officers also cordoned off homes in the Ladywell area as part of ongoing enquiries.

Teen murder accused claims he acted in self-defence

A teenager accused of murdering 15-year-old Amen Teklay has told a court he believed his alleged victim was about to stab his friend when he struck him with a sword.

Giving evidence at the High Court in Glasgow, the 16-year-old claimed Amen had produced a knife during a confrontation in Clarendon Street before turning towards his co-accused.

The boy admitted stabbing Amen but insisted he acted to protect his friend, telling jurors he feared the teenager was about to launch an attack. The trial, where both accused deny murder, continues.
